For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to www.boldexistence.com.au, Bold Existence Pty Ltd® (‘together Bold Existence’) and “You” and “Your” refers to you, the client, customer, visitor, website user or person using our website.

 

SHIPPING AND TAX

We are currently only shipping our physical books to Australia and the United States. This means if you reside outside of these two countries, we are unable to ship and deliver our physical books to you. We will update our terms and conditions as our distribution to other countries changes. Shipping and handling estimates are provided during checkout. Please note, these are estimates only. Your products may arrive sooner or later depending on courier and printing services.

Our books are printed-on-demand, which means everytime you place an order, your book will first be printed before it is shipped. If you choose a non-trackable shipping method, please note, we have no means of helping to track your order in the event of it going missing in transit. By choosing a non-trackable shipping option, you agree that we will not be held liable for any loses during transit. By law we are required to charge GST, Sales Tax and VAT on products and services sold depending on the country where the sales are made. Our physical book products are displayed with the product price, excluding taxes. Relevant taxes and shipping and handling fees are added during checkout. If you have questions about taxes charged to your products, please email us at info@boldexistence.com.au.

 

PAYMENT AND REFUNDS

 

We try to ensure our services are provided with due care and skill, and we at all times abide by the Australian Consumer Protection legislation with respect to any refund. Any other refund is done in accordance with our Refund Policy and in our sole discretion (*see below). All fees are non-refundable and are non-transferrable between products or services unless, during the period in which you paid for a product or service through this website, the product or service was not available. In this circumstance, a refund may be granted upon written request by email at info@boldexistence.com.au, however, you acknowledge that we may refuse a request where we are able to provide the product or service to you through alternative means (such as email).

Acceptance and continued access to our services and products are always subject to payment first being made by you. By using our services you agree that we will not be held liable for any loss you incur unless caused by our fraud or the fraud of our employees.

COMPETITION AND CONSUMER ACT

 

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Bold Existence’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

It is an essential pre-condition to you using our website that you agree and accept that Bold Existence is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

JURISDICTION
